Haldiram’s has sued Aahar Food Distributors for trademark infringement

India’s leading snack-maker Haldiram’s has filed a suit in the US district Court against US based Aahar Food Distributors LLC for allegedly importing, distributing and selling counterfeit products relating to Haldiram’s in the state. Haldiram India Private Ltd, known for selling quality snacks in India since 1980’s has alleged Aahar Food Distributors of using the registered trademark ‘HALDIRAM’ on its products and packaging in a manner which is deceptively similar to that of Haldiram’s and can cause consumer confusion at large.

They have further stated that any relevant customer would confuse the products sold by Aahar and would likely to be deceived into thinking that the product has originated from Haldiram’s. Aahar Food distributors have not only sold counterfeit products but also used Haldiram’s trademark for promotional and advertising activities of their products. Haldiram’s have demanded to be awarded statutory damages of an amount not less than $2,000,000 per counterfeit trademark per type of goods sold by Aahar Food Distributors for false representation and false designation of origin, common law trademark infringement, unfair competition, and injury to business reputation and an injunction order to restrain them from importing, buying, receiving, selling, distributing, counterfeit or copy and colorable imitation of Haldiram’s marks.
